Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of ONVA, a shared travel application available on iOS, Android, and the web at getonva.app. By creating an account or using the service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use ONVA.

2. Provider

References to "we", "us", or "our" mean the provider above. References to "you" or "User" mean the person using ONVA.

3. The Service

ONVA is a shared travel OS that helps couples, nomads, and creators plan and manage trips together. Core features include:

• Shared maps and pins visible to journey members
• Multi-currency expense tracking and splitting
• Trip chat per journey
• Itinerary planning
• Offline-capable travel document vault (premium)
• AI trip planner with journey-aware context (premium)
• Receipt and screenshot scanning for expenses (premium)
• Live activities map — browse and participate (premium)
• Publishing and forking pin collections (premium)

We may add, change, or discontinue features at any time. We will make reasonable efforts to avoid materially degrading the core experience for paying users during an active subscription or Trip Pass period.

4. Accounts and Eligibility

You must be at least 18 years old to use ONVA. You are responsible for keeping your login credentials secure and for all activity under your account.

You agree to provide accurate information and to keep your account details up to date. You may sign in via email magic link, Google OAuth (web), or supported mobile authentication providers.

5. Journeys and Companions

A "journey" is a shared trip workspace. You may invite up to 3 companions to a journey. Journey members can see shared content within that journey (maps, expenses, chat, documents, etc.) according to the features available on your plan.

If you have an active Trip Pass or Nomad subscription, premium features may extend to your journey companions while your plan is active. Only the account holder who purchased a subscription can join or create live activities.

You are responsible for whom you invite and what you share within a journey.

6. Free and Premium Plans

6.1 Free tier

The free tier includes shared maps, pins, trip chat, itinerary, and basic expense tracking. Premium features require a paid plan.

6.2 Trip Pass

Trip Pass is a one-time purchase that grants premium access for 7 days, including up to 75 AI planner messages for that pass period, receipt scanning, cloud vault sync, and other premium features listed at purchase. Trip Pass does not auto-renew.

6.3 Nomad (monthly and annual)

Nomad is a recurring subscription that grants premium access while active, including up to 150 AI planner messages per billing month, receipt scanning, cloud vault sync, live activities, and other premium features listed at purchase. Subscriptions auto-renew unless cancelled before the renewal date.

6.4 Usage limits

AI planner message limits, companion limits, and other plan restrictions are described in the app and on our website. We may adjust limits for new purchases with reasonable notice; existing active plans are honored for their current period.

7. Payments and Billing

7.1 Mobile (iOS and Android)

In-app purchases are processed by Apple (App Store) or Google (Play Store) via RevenueCat. Payment terms, renewals, cancellations, and refunds are governed by the applicable store's terms. To cancel a subscription, use your App Store or Google Play account settings.

7.2 Web

Web purchases are processed by Stripe. Prices are shown inclusive of applicable VAT where required. Subscriptions renew automatically unless cancelled through the customer portal or by contacting support before the renewal date.

7.3 Price changes

We may change prices for new purchases. For recurring subscriptions, we will notify you in advance where required by law or store policy.

8. Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the right to withdraw from a distance contract within 14 days of purchase without giving a reason.

For digital content and services, the right of withdrawal expires early if you expressly consent to immediate performance and acknowledge that you lose your withdrawal right once delivery begins. By activating premium features immediately after purchase, you agree to this.

For App Store and Google Play purchases, refund requests must be submitted through Apple or Google according to their policies. Contact us at support@getonva.app if you need help.

9. User Content

You retain ownership of content you upload or create in ONVA (pins, messages, expenses, documents, images, etc.). You grant us a limited license to host, store, process, and display that content solely to operate and improve the service for you and your journey members.

You agree not to upload or share content that:

• Violates any law or third-party rights
• Contains malware or harmful code
• Is abusive, harassing, or threatening
• Infringes intellectual property rights

We may remove content or suspend accounts that violate these Terms.

10. AI Trip Planner Disclaimer

The AI trip planner provides suggestions based on your journey data, location, and publicly available information. It is not professional travel, legal, medical, or financial advice. Always verify important details (visas, safety, bookings, prices) independently before acting on AI suggestions.

We are not responsible for decisions you make based on AI-generated content. Use your own judgment when traveling.

11. Acceptable Use

You agree not to:

• Use the service for unlawful purposes
• Attempt to access other users' accounts or data without permission
• Scrape, reverse engineer, or overload our systems
• Circumvent paywalls, usage limits, or security measures
• Resell or commercially exploit the service without our consent

12. Availability and Offline Use

We aim for high availability but do not guarantee uninterrupted service. Some features require an internet connection. Offline access to pins, expenses, and documents is provided on a best-effort basis and syncs when you reconnect.

13. Third-Party Services

ONVA may link to third-party booking sites (e.g. flights, hotels, activities). We do not control and are not responsible for third-party services, their pricing, or their terms. Map data and place information may come from third-party providers and may be inaccurate or incomplete.

14. Termination

You may delete your account at any time in the app under Settings → Delete account, or by emailing support@getonva.app. Paid subscriptions must be cancelled separately through the App Store, Google Play, or Stripe customer portal to avoid future charges.

We may suspend or terminate your account if you violate these Terms or if required by law. Upon termination, your right to use the service ends, but provisions that by nature should survive (e.g. liability limits, governing law) will remain in effect.

15. Limitation of Liability

To the fullest extent permitted by law, we are liable without limitation for damages arising from injury to life, body, or health, and for damages caused intentionally or through gross negligence.

For other damages, our liability is limited to foreseeable, typical contractual damages. We are not liable for indirect, incidental, or consequential damages, lost profits, or data loss except where mandatory law provides otherwise.

ONVA is a planning and organization tool. We are not liable for travel disruptions, booking errors, financial losses from expense splits, or reliance on AI suggestions.

16. Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms.

17. Changes to These Terms

We may update these Terms with at least 30 days' notice for material changes, via email or in-app notification. Continued use after the effective date constitutes acceptance. If you disagree with updated Terms, stop using the service and cancel any active subscriptions.

18. Governing Law and Disputes

These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a merchant, legal entity under public law, or public-law special fund, the courts at our registered seat have exclusive jurisdiction.

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

19. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. The invalid provision will be replaced by the minimum necessary valid provision that achieves the original intent.
